In compliance with the duty to inform contained in Art 10 of Act 34/2002, of July 11 on Services of the Information Society and e-Commerce, the following data are shown below: The owner of the web domain is ABISMA SYSTEMS SL, (henceforth ABISMA), with registered headquarters at C / Pau Alsina, 57, 1º 1º, 08024 Barcelona and Tax ID B67457598.

2. Users

Access and/or use of this portal of ABISMA implies the condition of user, as well as the acceptance since the moment of access and/or use, the General Conditions of Use expressed hereby. The said Conditions are applicable regardless of the General Conditions for Contracting that might apply.

3. Use of the web page

ABISMA provides access to information, services, programmes or data (henceforth “the contents”) over the Internet owned by ABISMA or its licensors that the USER may access. The USER is responsible for the use of the portal. Such responsibility extends to the registration that might be needed to access certain services or contents.

In such registration the USER is responsible to enter true and lawful information. Following this registration the USER might be provided with a password for which he is responsible, undertaking to use it in a serious and confidential way. The USER commits to use properly the contents and services (such as chat services, discussion forums or newsletter groups) that ABISMA offers through its portal for purposes including but not limited to (i) unlawful, illegal or contrary to good faith and public order; (ii) disseminating contents or propaganda that are racist, xenophobic, pornographic-illegal, supporting terrorism or against human rights ; (iii) cause damage to the physical or logical systems of the company tha owns the site, its suppliers or third parties, introducing or disseminating in the network viruses or any other physical or logical systems that might cause the aforementioned damage; (iv)  attempt to access and where applicable use the electronic mail accounts of other users and modify or manipulate their messages. ABISMA reserves the right to remove any remarks and contributions which infringe respect for personal dignity, which are against the law, or which in its opinion are not appropriate for publication. In any event, ABISMA will not be responsible for any opinions given by users through forums, chats, or other participation systems.

4. Data Protection

ABISMA complies with the directives of Organic Act 15/1999 dated 13th December on Personal Data Protection, Royal Decree1720/2007 dated 21st December enacting the Regulations developing the Organic Act and other legislation in force at any time, and shall make sure proper use and treatment of the user’s personal data is made. To this end, it shall inform the USER of the existence and acceptance of the specific conditions for treatment of their data in each case along with each formula collecting personal data, in the services that the user may request from ABISMA, informing the user of the responsibility for the file created, the address of the person responsible, the possibility of making use of their rights of access, rectification, cancellation or opposition, the purpose of the treatment and any communication of data to third parties, where applicable.

ABISMA is furthermore making known hereby that it complies with Act 34/2002 dated 11th July, on Services for the Information Society and Electronic Commerce and shall request their consent for processing their electronic mail.

5. Intellectual and industrial property

ABISMA either in its own right or as assignee or licensee pursuant to the consent given by its ASSOCIATES, is the owner of all the intellectual and industrial property rights of its web pages, as well as of the contents of these (for announcement purposes, illustrations, sound, audio, video, software or texts; trademarks or logotypes, combinations of colours, structure and design, selection of materials used, computer programs required for its operation, access and use, etc.), owned by ABISMA or by its associates or licensors.

Pursuant to what is laid down in articles 8 and 32.1, paragraph two, of the Intellectual Property Act, any reproduction, distribution and public communication, including the system for making this available, of all or part of the contents of this web page, for commercial purposes, on any support and by any technical means, is forbidden without the consent of ABISMA. The USER undertakes to respect the Intellectual and Industrial Property rights held by ABISMA. He or she may view the items on the Site and even print these, copy them and store them on the hard disk of their computer or on any other physical support on condition that this is only and exclusively for their personal and private use. The user shall refrain from removing, altering, eluding or tampering with any protection device or safety system which might be installed on the pages of ABISMA.  

6. Disclaimer of guarantees and liability

ABISMA accepts no liability, under any circumstances, for any damages of any kind that might be caused by, merely for announcement purposes, any errors or omissions in the contents, lack of availability of the portal or transmission of viruses or malicious or harmful programs in the contents, in spite of having implemented all the technological measures required for avoiding this. 

7. Modifications

ABISMA reserves the right to make, with no prior notice, any modifications that it may deem fit to its Site. It shall be able to change, remove or add both the contents and services granted through this and the way these are presented or located on its Site.  

8. Links

In the case of ABISMA.es if there are links to other web sites on the Internet, ABISMA has no control over such sites and their contents. Under no circumstances shall ABISMA assume any responsibility for the contents of any link belonging to an outside web site, nor shall it guarantee the technical availability, quality, reliability, accuracy, amplitude, truthfulness, validity and constitutionality of any material or information contained in any of such hyperlinks or other Internet sites.

 Likewise, including these external connections shall not imply any kind of association, fusion or participation with the concerns connected

9. Right to exclusion

ABISMA reserves the right to refuse or withdraw access to its Site and/or the services offered with no need for any prior notice, at its own request or that of a third party, for any users not complying with these General Usage Conditions. 

10. General

ABISMA shall pursue any non-compliance of these conditions as well as any improper use of its Site, bringing any civil and criminal action to which it may be lawfully entitled.

11. Modification of these conditions and duration

ABISMA may modify the conditions determined herein at any time, being duly published as appearing herein. The current validity of said conditions shall depend on their announcement and these shall be in force until they are modified by others, duly published.

12. Applicable law and jurisdiction

The relations between ABISMA and the user shall be governed by current Spanish legislation and any disagreement shall be submitted to the Courts and Tribunals.
